1. Who these terms are with
EPSpeak (“the app“) is operated by MANOAI Pty Ltd (ABN 48 689 793 244, ACN 689 793 244) (“we“, “us“), of Capital Square Towers, Level 25, Tower 3, 1 Spring Street, Perth, WA 6000, Australia (www.manoai.ai).
By installing or using the app you agree to these terms. If you do not agree, do not use the app. Contact: admin@manoai.ai.
2. What the app is
EPSpeak is a wellness application. You read a short affirmation aloud; the app records your voice and, at the same time, movement readings from your phone’s motion sensors. From these it produces summaries of how your voice and movement compare with your own earlier readings. You can also record wellness check-ins, keep a log of your medications, and optionally connect a fitness tracker.
The app is free. There are no purchases, subscriptions or paid tiers.
3. What the app is not
EPSpeak is not a medical device, and nothing it shows you is a diagnosis, a medical opinion, or advice about your treatment.
- It does not detect, diagnose, monitor, predict, treat or alleviate any disease or condition.
- Its scores describe how a reading differs from your own earlier readings. A change may have many causes — a cold, a noisy room, tiredness, how you held the phone. It does not mean anything is wrong.
- Never start, stop or change a medication because of anything the app shows you. Talk to your prescriber.
- The app is not for emergencies. If you are unwell or in crisis, contact your doctor or your local emergency number. In Australia call 000; for crisis support, Lifeline is 13 11 14.
4. Who may use it
You must be 16 or over. If you are using the app as part of a supervised research pilot, your participation is arranged separately with the research team and is governed by the consent you give them, not by these terms.
The app signs you in anonymously. It does not ask for your name, email address or any account credentials, and there is no login. This means we cannot identify you, and cannot recover your data for you if you uninstall the app or clear its data.
5. Your recordings and your data
What we collect, why, where it is stored and how to have it deleted is set out in our Privacy Policy at https://manoai.ai/privacy/, which forms part of these terms. In summary: voice recordings, motion measures, wellness answers, medication entries and any connected tracker data are health information; they are stored under a random identifier rather than your name, and are never sold or shared with advertisers.
You keep ownership of your recordings. You grant us permission to process them in order to provide the app, and — only if you have separately consented to take part in the research pilot — to use them for the research described to you at that time.
You are responsible for what you record. Do not record other people without their agreement, and do not record anything you would not want stored.
6. Connecting a fitness tracker
Connecting a tracker is optional and requires your separate consent, given on Google’s own screen, to the Google Health API permissions the app requests. Your use of Google’s services is subject to Google’s terms, not ours.
You can disconnect at any time in Settings, which revokes our access to your Google account. Connecting also has to be approved for your Google address before it will work; that is arranged with the research team and cannot be enabled from within the app.
7. Using the app properly
Do not attempt to access another person’s data, interfere with the app’s security, reverse-engineer it except to the extent Australian law permits, or use it in a way that breaks the law. We may stop providing the app, or any part of it, at any time.
8. Availability, and our liability
The app is provided “as is”. We do not warrant that it will be uninterrupted, error-free, or that its measurements are accurate, complete or clinically meaningful — and section 3 says plainly that they are not intended to be.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded. Where our liability can be limited, it is limited to resupplying the app or the cost of doing so. To the extent permitted by law, we are not liable for indirect or consequential loss, nor for any decision you make about your health or medication on the basis of what the app shows you.
9. Governing law
These terms are governed by the laws of Western Australia, Australia, and you and we submit to the non-exclusive jurisdiction of its courts.
10. Changes
We may update these terms. The version published at https://manoai.ai/terms/ with its date is the current one; continuing to use the app after a change means you accept it. Material changes affecting how your health information is handled will also be reflected in the Privacy Policy.
